Terms of Sales

Eldino sàrl, whose registered office is located at 5, rue du Pont-Neuf, 1227 Carouge, Switzerland (hereinafter "eldino.ch"), operates an online store. The offers offered are intended for adults and legal persons domiciled in Switzerland (hereinafter the "Client"). The delivery area is limited to the territories of Switzerland.

These general conditions of sale (hereinafter "GTC") govern the entire purchasing procedure on eldino.ch, in particular the registration of Customers, the recording and use of data concerning them, orders, deliveries, payments, and any claims.

Product offers and prices

The price of the products available on eldino.ch is expressed in Swiss francs and already includes all possible taxes and charges (such as VAT). For products sold by weight, the price displayed corresponds to the price of the unit by weight. In addition, the price of transport is the responsibility of the Customer but is not indicated in the price of the products. Shipping costs can be viewed here.

The display of the price for a product does not constitute an offer, since its availability and quantity cannot be guaranteed.

The images presented in advertisements, leaflets, the website, etc., as well as all of the information concerning the products (list of ingredients, nutritional values, indications relating to allergens, etc.) serve purely as illustrations. indicative and are not contractual. In exceptional cases, these descriptions may not correspond to the information on the product packaging. In this case, the information on the packaging will prevail.

Eldino.ch reserves the right to generally limit the deliverable quantity of certain products, or even not to deliver a given product.

Orders

Orders on eldino.ch are made exclusively online.

Once the Customer has made his choice of products, these will appear in the shopping cart. The total price includes the price, all taxes included, and transport costs.

By confirming his order, the Customer makes an offer to purchase. By clicking on this button, the Customer confirms the accuracy of all the information he has indicated. At this stage, the validation of the order only proves that the Customer's order has reached eldino.ch but does not yet constitute acceptance of the Customer's offer. Within a short time after the order, the Customer receives by email from eldino.ch, a confirmation of receipt of the order, which constitutes proof of the sales contract between eldino.ch and the Customer. Only this confirmation by email validates the establishment of a contractual link between the parties.

In the current state of technology, it is not possible to guarantee that the transfer of data via the Internet functions without error and / or constantly. Eldino.ch is not responsible for the permanent and uninterrupted availability of its website, nor for technical and electronic errors which may occur during the ordering process. In particular, it cannot be held responsible for delays in processing, acceptance of orders, or errors in handling the credit card.

Finally, eldino.ch reserves the right to cancel orders. In this case, the Customer will be informed by email before the delivery of the products and will be reimbursed if necessary.

Payment

Payment is due and payable as soon as confirmation of receipt of the order is received by email. Several methods of payment are available, but eldino.ch reserves the right to decide the means of payment accepted in special cases.

The possible means of payment are:

The possible means of payment are indicated at the time of the order.

For payment methods, the Customer enters the access data required for online banking services on an internet platform made available by the third party concerned. This internet portal and the corresponding technical infrastructure necessary for the transmission of access data are beyond the sphere of influence of eldino.ch. Consequently, eldino.ch declines all responsibility for the use of these payment methods by the Customer.

Loyalty bonuses

Eldino.ch may grant loyalty bonuses in the form of discounts, gift vouchers, free products.

Retention of title

The products remain the property of eldino.ch until full payment of the order price. The client authorizes eldino.ch to proceed, at the expense of the Client, to the corresponding entry in the register of retention of title.

Subcontractors

Eldino.ch has concluded contracts with the following subcontractors:

  • La Poste - for delivery
  • Stripe - for online payment
  • Paypal - for online payment

Delivery

The ordered products are delivered to the delivery address within 2 to 5 working days. No deliveries are made on Sundays or official national holidays and those of the Canton of Geneva. The confirmation of receipt of an order may indicate an indicative deadline, but this deadline does not constitute a contractual commitment and may be modified at any time.

Delivery can be made by a partner service. The order is placed at the delivery address, as a rule in the milk box (letter box), in front of the front door, or directly to the person that the Customer has previously designated. The Customer therefore accepts that in case of absence his order is simply dropped off at the delivery address he has indicated. The Customer is required to provide exact information on the delivery address. If, failing this, eldino.ch should be unable to make the delivery due to an incorrect address provided by the Customer, eldino.ch is entitled to cancel the order and invoice the Customer a sum flat rate of CHF 50.00 for administrative costs.

The Customer bears the risks linked to the transport of the products to the delivery address indicated. However, eldino.ch undertakes to respect the cold chain until delivery of the order to the address indicated. As soon as the delivery is made, the Customer assumes full responsibility for respecting the cold chain.

If eldino.ch or the delivery partner are unable to deliver an order confirmed by email, eldino.ch cancels the order and informs the Customer by email. The Customer is not entitled to any compensation, except for the reimbursement of the price of the products if the payment has already been made.

Standard delivery price:

  • Packages up to 2 kg: CHF 7
  • Packages from 2 to 10 kg: CHF 9.70
  • Packages from 10 to 30 kg: CHF 20.50

Delivery is offered to the Customer from CHF 79 purchase per order.

Client Rights

Eldino.ch guarantees the quality and the shelf life of the products under the following conditions:

  • Unrefrigerated products must be stored in a cool and dry place;
  • Refrigerated products must be unpacked immediately after receipt and stored at a temperature of max. 2-5 ° Celsius.
  • Frozen products must be treated properly and stored at -18 ° Celsius without interrupting the cold chain.
  • Eldino.ch undertakes to select quality products which meet the intolerances mentioned. However, eldino.ch cannot check in place of the Client his state of health and any intolerances / allergies. Eldino.ch therefore does not guarantee that the products are suitable for the Customer's intolerances and allergies.

Provided that the Customer can demonstrate compliance with its obligations, eldino.ch assumes the guarantee of defects in the products ordered until the expiration of the conservation date, but at most 2 years from the delivery date. For products without a conservation date, the legal period of 2 years from the date of delivery applies.

In the event of a product defect, eldino.ch exclusively offers the Customer a partial or complete replacement with an equivalent product or a reduction in the price of the product. The termination of the contract is only possible when the product cannot legitimately be used or consumed without causing harm to health.

There is no general right of return on products without defects and correctly delivered. The warranty is explicitly excluded for products whose intrinsic quality does not meet the requirements of the Customer (for example taste requirements).

Force Majeure

Eldino.ch is not responsible for a violation of its obligations insofar as this failure results from an external cause which escapes the reasonable control of eldino.ch, such as for example severe weather, an epidemic, a pandemic, or acts of vandalism (a "force majeure"). Eldino.ch undertakes to notify the Client as soon as it becomes aware of a case of force majeure and to do everything that is reasonably possible to overcome the event.

When an event constituting force majeure occurs, the dates and periods relating to the performance of the obligations arising from these GTCS will be adapted by the parties by mutual agreement. In the absence of agreement, the dates and periods will be extended by a period equivalent to the duration of force majeure, to which will be added a reasonable period for the resumption of the performance of its obligations by the party.

Eldino.ch is not obliged to pay damages, such as delay compensation, for damages caused by the occurrence of an event constituting force majeure. However, if the events constituting force majeure persist, the Customer may declare the termination of the contract and must in this case notify it to eldino.ch within a reasonable time.

Use of the website

The Customer is also responsible for the security of his customer account. In particular, the Customer must not disclose to other persons the identifiers of his account, his bank details, his password and must protect this information against access by other persons.

The Customer is personally responsible for ensuring that their use of the website does not violate these GTCS or any other applicable law or regulation (for example, criminal laws, data protection laws) and does not infringe the rights of third parties (including copyright, database rights, trademark rights, design rights, patent rights, license rights, etc.).

The Customer will browse the website with the greatest of care. In particular, the Client may not use the website servers for any form of excessive automated mass activity (for example, spam), or relay any other form of unsolicited advertising or solicitation through the servers d'eldino.ch, nor attempt to disturb or modify the servers in a way which could harm the website or the services, or any other user of the services. Eldino.ch reserves the right to suspend or terminate access to the disruptive Customer's website without notice in the event of abuse.

Ultimately, the website may contain links to websites or services of third parties that eldino.ch does not own or control. Eldino.ch assumes no responsibility for the content, privacy policies or practices of any third-party websites or services.

Eldino.ch protects the Customer's personal data according to the Personal Data Protection Policy which can be viewed here.. This Policy is an integral part of these GTC.

The Customer also agrees not to transmit sensitive data (health data for example) which would not be useful for eldino.ch.

Responsibility of eldino.ch

Eldino.ch, including its auxiliaries, cannot be held liable for damages greater than the price of the disputed order, to the extent permitted by applicable law.

Furthermore, and except in the event of serious misconduct, eldino.ch excludes all liability vis-à-vis the Customer, or his assistants, for all damage suffered as a result of a cyber-attack on the website or due to improper use of the product ordered.

All the GTC

These GTCS constitute the agreement between the parties, to which must be added any written or electronic correspondence exchanged upon conclusion of the sales contract. These GTC replace and cancel the agreements previously concluded between the parties, whether verbally or in writing, having regard to the questions presented.

Applicable law and dispute resolution

These GTCS as well as all subsequent modifications are subject to Swiss law, in particular Art. 184 ff Swiss Code of Obligations. The Courts of the canton of Geneva are competent for any litigation in connection with the present CGV.
